Terms of Service

1. Agreement to terms

By creating an account or using the Infosky Solutions platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. These terms apply to all users, including businesses, organisations and individuals who access the platform.

Infosky Solutions is operated by Infosky Solutions Ltd, Karen, Nairobi, Kenya.

2. The platform

Infosky Solutions provides a web-based platform that enables businesses to send bulk SMS messages, WhatsApp Business messages, and OTP (one-time password) messages to their customers and contacts across Kenyan mobile networks.

We reserve the right to modify, suspend or discontinue any part of the platform at any time with reasonable notice.

3. Account registration

To use the platform, you must:

4. Acceptable use

You may only use the platform to send messages that comply with all applicable laws and regulations, including the Kenya Data Protection Act 2019, the Kenya Information and Communications Act, and Communications Authority of Kenya regulations.

5. Sender ID registration

Custom Sender IDs must be registered with the Communications Authority of Kenya (CA Kenya). By requesting a custom Sender ID, you confirm that the name belongs to your organisation and that you have the right to use it. Infosky Solutions facilitates the registration process but cannot guarantee approval by CA Kenya.

6. Payments and credits

The platform operates on a prepaid credit basis. Credits are purchased via M-Pesa or bank transfer and deducted per message sent. Credits are non-refundable once purchased, except in cases of platform error.

Prices are stated in Kenyan Shillings (KES) and are subject to change with 14 days' notice to registered users.

7. Delivery

We will make reasonable efforts to deliver messages to the intended recipients via Safaricom, Airtel and Telkom networks. Delivery is subject to network availability, recipient handset status and other factors outside our control. We do not guarantee delivery of every message.

8. Data and privacy

Your use of the platform is also governed by our Privacy Policy, which forms part of these Terms of Service. You are responsible for ensuring that your use of contact data complies with the Kenya Data Protection Act 2019 and that you have obtained appropriate consent from your contacts.

9. Intellectual property

The Infosky Solutions platform, including its software, design, branding and content, is owned by Infosky Solutions Ltd and is protected by applicable intellectual property laws. You may not copy, modify, distribute or reverse-engineer any part of the platform without our written permission.

Message content and contact data that you upload remains your intellectual property. By uploading content, you grant us a limited licence to process it solely for the purpose of delivering the services you have requested.

10. Limitation of liability

To the maximum extent permitted by Kenyan law, Infosky Solutions and Infosky Solutions Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the platform, including loss of revenue, loss of data or business interruption.

Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid for services in the 3 months preceding the claim.

11. Termination

Either party may terminate the service relationship at any time. You may close your account by contacting us. We may suspend or terminate your account immediately if you violate these Terms of Service. Unused credits at the time of termination are non-refundable.

12. Governing law

These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Kenyan courts.

13. Changes to these terms

We may update these Terms of Service from time to time. We will notify registered users of significant changes by email at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance.
