Infosky Solutions Limited ("Infosky Solutions", "we", "us" or "our") is a business messaging platform operated by Infosky Solutions Ltd, registered in Kenya. Our registered address is Karen, Nairobi, Kenya. P.O Box 13663-00800 Nairobi.

We provide bulk SMS, WhatsApp Business messaging and OTP delivery services to businesses and organisations across Kenya.

2. Information we collect

When you use our platform or contact us, we may collect the following personal information:

• Full name and job title
• Business name and registered address
• Email address and phone number
• Billing information (processed securely via M-Pesa or bank transfer)
• Message content and campaign data created within the platform
• Contact lists uploaded to the platform
• Usage data including login times, pages visited and features used

• Create and manage your account on the Infosky Solutions platform

4. Contact lists and message content

Contact lists and message content that you upload or create within the platform belong to you. Infosky Solutions processes this data solely to deliver the services you have requested. We do not sell, share or use your contact data for our own marketing purposes.

You are responsible for ensuring that you have obtained appropriate consent from your own contacts before sending them messages through our platform, in accordance with the Kenya Data Protection Act 2019 and Communications Authority of Kenya regulations.

5. Data sharing

We do not sell your personal data to third parties. We may share data with:

• Mobile network operators (Safaricom, Airtel, Telkom) — to deliver messages to their subscribers
• Payment processors — to process M-Pesa and bank payments securely
• Infrastructure providers — cloud hosting and security services bound by data processing agreements
• Regulatory authorities — where required by law, including the Communications Authority of Kenya

6. Data retention

We retain your account data for as long as your account is active. Message delivery logs are retained for up to 12 months. If you close your account, we will delete or anonymise your personal data within 90 days, except where retention is required by law.

Under the Kenya Data Protection Act 2019, you have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your data (subject to legal retention obligations)
